To support Candidate safety and uphold organisational standards, it is imperative that the Candidate agrees to accept the Terms & Conditions outlined in this document. Registering online as a Candidate, which requires a tick box agreeing to our Terms & Conditions, and accepting any booking or placement, constitutes immediate acceptance of the Terms & Conditions listed.
1.1 The below Terms & Conditions are a legal binding agreement between you as a Candidate, and Rockmybaby® as the agency. This is for Rockmybaby® Group.
1.2 Completion of the following – registering on the Rockmybaby® website, and/or acceptance of a babysitting booking/temp or permanent placement – is instant acceptance of the agency Terms & Conditions.
1.3 The word “Rockmybaby®” refers to Rockmybaby® Nanny & Babysitting Agency (Agency).
1.4 The word “Client” refers to the person/family/employer using Rockmybaby® services.
1.5 The word "Candidate" refers to any person that Rockmybaby® introduces to the Client.
1.6 The word “Nanny” refers to a childcare professional who is registered with Rockmybaby® who may be engaged by a Client in a full time/ part time/ temporary capacity.
1.7. The word “Babysitter” refers to a childcare professional who is registered with Rockmybaby® who may be engaged by a Client in a babysitting capacity.
1.8. The Terms & Conditions are the terms of which Rockmybaby® offers the Candidate access to the services and use of the Rockmybaby® website and agency. By registering with Rockmybaby® the Candidate agrees to abide by these Terms & Conditions. If the Candidate does not agree to abide by these Terms & Conditions, then the Candidate must refrain from using the Rockmybaby® website.
1.9 Posting false, incomplete, inaccurate or illegal information is strictly prohibited and may be punishable by law.
1.10 Unlawful or illegal use will be reported to the proper authorities and may be punishable by law.
2.1. The Candidate must register on the Rockmybaby® website https://www.rockmybaby.com.au/users/register and complete the full recruitment process including: interview; reference checks; police vetting; provision of appropriate forms of identification documents; and provision of current Provide First Aid certificate.
2.2 The Candidate may not enter into a private arrangement with any Clients that they have been introduced to via Rockmybaby®
Should this be discovered, fees will apply to both the Candidate and the Client, and both parties will be removed from our services.
2.3 The Candidate must hold a current Provide First Aid Certificate (including unit standard HLTAID003) before children are placed in their care, or have booked a course to obtain.
2.4 Candidates agree that during their shift, that they have sole responsibility of the Rockmybaby® Client’s children – under NO circumstances can the Candidate leave the child alone or unattended.
2.5 Candidates must always respect Rockmybaby® Client property and privacy and leave the environment as they found it, except where the Candidate tidies/cleans up as appropriate.
2.6 Candidates are not permitted to use the Client’s private phone unless in the case of an emergency.
2.7 Candidates must appropriately engage with the children in their care and refrain from using their personal phone, unless in the case of emergency.
2.8 The Candidate is aware that Rockmybaby® reserves the right to check social media profiles, and where content is deemed inappropriate and doesn’t reflect Rockmybaby® values, Rockmybaby® reserves the right to suspend the Candidate from services.
2.9 Where a dispute arises between the Candidate/Client/Rockmybaby® Agency the Candidate is to refrain from contacting the Client. All communication regarding a dispute is to remain between the Candidates and Rockmybaby® Agency only.
2.10 All communication between the parties (Agency/Client/Candidate) shall remain confidential.
2.11 Tax obligations - Rockmybaby® is a babysitting agency (not your employer). The Candidate is responsible for paying any tax obligations on babysitting booking/nannying. Rockmybaby® advises all Candidates to contact ATO to understand their tax obligations – visit https://www.ato.gov.au/ 2.12 Rockmybaby® values transparency and honesty with our clients and candidates regarding Health and Safety. Safe and Healthy Work Environment - The candidate is required to take all reasonable steps in the course of their employment or contracted work, to ensure their own safety and the safety of others. The Candidate agrees to fully co-operate with the clients and Rockmybaby® in implementing the health and safety practises. All hazards identified by the candidate in the workplace are to be brought to the attention of the client and/or Rockmybaby® as soon as practicable so that remedial action may be taken as appropriate. The candidate is required to report all illnesses/accidents/injuries and near-misses that occur, arising out of or in the course of their employment or contracted work, to the client and/or Rockmybaby® as soon as is reasonably practicable. The candidate agrees to report any symptoms that may indicate the development of any workplace illness or injury including any gradual process injury, to the client and/or Rockmybaby® without delay.
2.12 A Candidate shall respect the property and the privacy of the Client at all times. In no circumstances can a Candidate photograph the children or the property of the Client without parental consent, post information or photographs on social media, or share any information to a third party, pertaining to the Client.
3.1 Rockmybaby® may cancel the Candidate registration for any breach of serious misconduct i.e. not turning up to a booking, sleeping on the job, any form of disrespect or abuse to the child(ren) or Client property, or failure to abide by Terms & Conditions.
3.2 The babysitter Candidate must contact the family within 24 hours (or sooner in the case of an emergency booking) of accepting a booking to introduce themselves, and confirm start and finish time, address/location and directions as required.
3.3 Rates are set by Rockmybaby® and differ by region and are not to be negotiated by the babysitting Candidate. Please refer to https://www.rockmybaby.com.au/pages/fees for current regional rates. Babysitting Candidates must confirm with the Client the hourly rate to be paid at the end of the booking (minimum of 3 hours).
3.4 The babysitter Candidate must turn up to the booking before the start time.
3.5 The babysitter Candidate must agree to fulfil any accepted bookings, unless in the case of an emergency.
3.6 The babysitter Candidate must give appropriate due notice in the event they can’t fulfil a booking (within 24 hours).
3.7 The babysitter Candidate agrees that care must take place on the agreed premises only, unless express permission is granted from the Client (for example taking child on an outing to the park).
4.1 On arrival at your placement, the Candidate must be clear and comfortable with any Client requests.
4.2 Safety of our Candidates is of high importance to Rockmybaby®. It is important to Rockmybaby® that the Candidate always feels safe and secure. In the unlikely event that the Candidate feels threatened or unsafe while attending a booking/placement, please contact Rockmybaby® immediately for support.
4.3 Candidates are advised to have the Rockmybaby® number 1800 118 262 programmed into their phone, in case they need to call during the booking, or in the case of an emergency.
5.1 Babysitter Candidates are advised to let a friend or relative know exactly where they are, what they are doing, and what time they are expected back.
5.2 Babysitter Candidates are advised to use the Rockmybaby® job summary form for their own reference. Candidates are encouraged to ensure this form is completed and signed at the beginning of job placement, as it clearly states Client and Candidate expectations. It is not required that the Candidate supplies these to Rockmybaby®.
6.1 If the babysitter Candidate needs to cancel a job that they had accepted, the Candidate must advise Rockmybaby® no later than 72 hours before the job is due, allowing Rockmybaby® time to find a replacement Babysitter Candidate.
6.2 If the babysitter Candidate cancels within 24 hours of the job commencement time, the Candidate is required to call both Rockmybaby® and the Client directly. This call to the Client is out of courtesy.
6.3 If the babysitter Candidate has confirmed a babysitting booking, they are responsible to uphold their commitment to the Client and to Rockmybaby®. This is important for the reputation of the service provided by Rockmybaby®, and the rest of the Rockmybaby® team.
7.1 If Rockmybaby® has put the Nanny Candidate forward for any nanny positions - the Nanny is required to inform Rockmybaby® when they are planning to interview with the Client, to keep us informed of any communication, and inform us if employment has been offered to them.
7.2 If the Candidate has been put forward to the same nanny position that is advertised via a third- party, they must inform Rockmybaby® immediately, and make Rockmybaby® aware whether Rockmybaby® or the third-party put the Candidate forward first.
7.3 Candidates are covered by the Rockmybaby® Public & Statutory Liability insurance, except regarding the transport or use of the Client’s vehicle by the Candidate, in which case, Candidates need to ensure they are covered by the Client’s car insurance policy.
8.1 By using the Rockmybaby® Agency the Candidate expressly authorizes Rockmybaby® to collect and publish information about them as detailed in these terms and conditions. The Candidate expressly waive any rights, whether in statute or at common law, to bring any legal action against Rockmybaby® as a result of Rockmybaby® publication of such information, whether the Candidate considers that information to be fair and accurate or not.
8.2 Rockmybaby® acts as an agent for the Client, not as an employer of the Nanny or Babysitter Candidate. Therefore, the agency accepts no liability or responsibility for accident, injury, loss, damage, or misconduct sustained by Nanny or Babysitter Candidate, Clients or any other persons. By working as Nanny or a Babysitter through Rockmybaby®, the Candidate agrees to exclude the Rockmybaby® agency should any mishap occur.
8.3 Rockmybaby® website contains links to third party advertisements and links to third party sites. Access to any other Internet site linked to the Rockmybaby® website, is at the Candidate’s own risk. Rockmybaby® accepts no responsibility for the accuracy or reliability of any information, opinions, or statements made in any third-party advertisements, or on any third-party sites.
8.4 Any outside users from other countries can access this website – Rockmybaby® makes no representation, the Candidate expressly waive any rights, whether in statute or at common law, to bring any legal action against Rockmybaby® as a result of Rockmybaby® publication of content within this website. The Candidate is responsible for ensuring compliance with all laws where they are located.
9.1 All communication between both parties (Rockmybaby® Agency & Candidates) shall remain confidential.
9.2 Rockmybaby® requires the Candidate to provide accurate details of their address, contact details and full name.
9.3 Rockmybaby® will release account and other personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our Terms and Conditions; or protect the rights, property, or safety of Rockmybaby® Group, our users, or others. However, Rockmybaby® authorises the Babysitter Candidate to tell a family member or friend where she/he will be, the expected return time, and address of the babysitting booking. This is a simple safety measure for the Candidate.

11.1 The Candidate is not and will not hold themselves out as an agent of Rockmybaby® on any basis.
11.3 Rockmybaby® makes no warranties or representations as to the quality, accuracy or completeness of the content on the Rockmybaby® website, or the information otherwise provided by any member.
11.4 The Candidate is fully responsible for negotiating any contracting arrangements with the Client, and all or any legal responsibilities owed by them to the Client including, without limitation, any employment obligation or contractual responsibilities.
11.5 The Candidate will hold Rockmybaby® harmless against any claims arising out of any claims brought against it, arising from the Candidate’s dealings with and treatment by the Client howsoever arising.
11.6 While Rockmybaby® uses reasonable endeavours to ensure that the site is available 24 hours a day, Rockmybaby® does not make any representations or warranties that access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, webhosting errors, maintenance or repair, or any reason beyond our control.
12.1 Rockmybaby® prefers to resolve any disputes via mediation – please contact Head office at info@rockmybaby.com.au or call 1800 118 262 with full details.
12.2 Where a dispute arises between the Client/Candidate/Rockmybaby® Agency the Candidate is to refrain from contacting the Client. All communication regards a dispute are to be kept between the Candidate and Rockmybaby® Agency only.
13.1 All content on Rockmybaby® website – texts, graphics, images, HMTL codes and other material (collectively the “Material”) are protected by New Zealand and international copyright laws and remain the exclusive property of the Rockmybaby® IP Ltd Company.
14.1 The Terms & Conditions shall be governed in accordance with the laws of the state of Australia and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
14.2 Rockmybaby® website, IP, Copyright is owned and registered by Rockmybaby Group, PO BOX 8720, Havelock North, New Zealand, 4157.
